These Terms and Conditions ("Terms") govern your use of the website located at www.carsondeckandfence.com and your engagement with Carson Deck & Fence ("we," "us," or "our") for deck, fence, and related outdoor construction services. By accessing this Site or requesting services, you agree to be bound by these Terms.
By using this Site or entering into a service agreement with Carson Deck & Fence, you confirm that you are at least 18 years old, have the legal authority to enter into a binding agreement, and accept these Terms in full. If you do not agree to these Terms, please do not use this Site or engage our services.
Carson Deck & Fence provides deck construction, fence installation, deck repair, deck staining and sealing, pergola installation, and related outdoor construction services to residential and commercial customers in Carson, CA and surrounding communities.
Services are subject to availability, site conditions, permit approvals, and material lead times. We reserve the right to decline a project if site conditions make it unsafe, unpermittable, or outside our scope of work.
Initial estimates provided by Carson Deck & Fence are based on information available at the time of the estimate and are subject to change. A written estimate becomes a binding project proposal only when both parties have signed a written contract.
Free on-site estimates are provided at no charge and with no obligation. Estimates do not constitute a commitment to perform work or guarantee a final price. Final pricing may be adjusted if site conditions, material costs, or project scope differ materially from what was assessed at the time of the estimate.
Any changes to the agreed scope of work after a contract is signed must be documented in a written change order signed by both parties before work on the changed scope begins.
Project start dates are estimates and may be affected by weather, permit processing times, material availability, and prior project completions. We will communicate scheduling updates promptly.
Either party may cancel a project prior to the start of construction by providing written notice. If the customer cancels after materials have been ordered or custom-fabricated for the project, the customer may be responsible for the cost of those materials up to the amount already incurred.
We reserve the right to pause or reschedule work due to unsafe weather conditions, permit delays outside our control, or circumstances that make continuation of work impractical or unsafe.
Payment schedules are outlined in the signed project contract. In general, a deposit is due before materials are ordered, with the balance due upon substantial completion of the project. We accept payment by check, bank transfer, or other methods specified in the contract.
Final payment is due upon substantial completion of the project. Withholding final payment due to minor punch-list items that are actively being addressed is not permitted. Any disputed amounts must be raised in writing within 5 business days of project completion.
Accounts not paid within the terms of the signed contract may be subject to late fees and collection costs, including reasonable attorneys fees, as permitted by California law.
Carson Deck & Fence will apply for required building permits on behalf of the customer for projects that require them under applicable local and state codes. The cost of permits is typically included in the project estimate or itemized separately. The customer is responsible for ensuring that their property complies with any applicable HOA rules or deed restrictions, as these are separate from local government permitting.
We build to California Building Code standards. Projects are subject to inspection by local building officials, and the customer agrees to provide reasonable access to the property for inspections.
Carson Deck & Fence warrants that all work will be performed in a workmanlike manner and in accordance with the signed project contract and applicable building codes. Specific warranty terms, including the duration and coverage of any workmanship warranty, are outlined in the signed project contract.
Manufacturer warranties on materials (composite decking, railing systems, vinyl fencing, and similar products) are passed through to the customer and are subject to the terms set by each manufacturer. We do not extend or modify manufacturer warranties.
Warranty claims must be submitted in writing to contact@carsondeckandfence.com. Warranty coverage does not apply to damage caused by customer misuse, improper maintenance, acts of nature, or modifications made by parties other than Carson Deck & Fence.
To the fullest extent permitted by applicable law, Carson Deck & Fence shall not be liable for any indirect, incidental, consequential, punitive, or special damages arising from the use of this Site or from the provision of services, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising from a service project shall not exceed the total amount paid by you for that specific project. This limitation applies regardless of the legal theory under which the claim is brought.

If a dispute cannot be resolved informally, the parties agree to attempt mediation before initiating litigation or arbitration. Any legal proceedings that cannot be resolved through mediation shall be brought in the appropriate state or federal court located in Los Angeles County, CA.
These Terms and any disputes arising from them are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
We may update these Terms from time to time. When we do, we will revise the effective date at the top of this page. Continued use of the Site after updated Terms are posted constitutes your acceptance of the revised Terms. We recommend reviewing this page periodically.
